Terms & Conditions


Definitions:
1.1 The “Applicant” refers to the guardian / parent, who must be of a legal age of at least 21 years old as of March 2013.


1.2 “Vendor(s)” refers to the stall operators, Children of age 7 – 12 years old. (up to 4 vendors per stall)


1.3 “Organizer” refers to Sentosa Leisure Management Pte Ltd who is the organizer of the Event.


1.4 “Event” refers to the “Sentosa KidZ Flea 2013”.


Empathy contribution:
2.1 As part of the objective of the program to learn about empathy and social responsibility, a mandatory donation of 20% of total sales profits is to be made to Sentosa’s designated charity association upon completion of business period. Donations must be made by cash. A receipt will be provided.


Operation:
3.1 The Applicant is required to abide the Event operation hours at all time. Event operates daily from 16-24th March 2013 from 2pm to 7pm at Sentosa Beach Plaza.


3.2 The Applicant is only allowed to setup one (1) hour before the commencement of Event time. The Applicant is to ensure that the stalls remain operational throughout the Event timing.


3.3 This is a rain or shine event. Organizer will provide Gazebo Marquee Shelters with side canvas sheets; however the Applicant is strongly advised to bring his own canvas covers as additional protection for stall items.


3.4 At all times, only registered vendor(s) are allowed to run the stall. No sub contracting of stalls are allowed.


Allocation of Stall Space:
4.1 All stall locations are pre-assigned and the actual stall allocation will only be made known on the actual day of Event.


4.2 The Applicant shall only be permitted to sell items that have been approved by the Organizer. The Organizer reserves the right to reject individual items that have not been approved.


4.3 Items Restriction or subject to prior arrangement:

 Food items
 Counterfeit items

 Torn and broken items

 Pavement art (chalk art)

 Utilization of dangerous materials

 Tarot card/palm readings/fortune telling

 Masseurs or masseuses

 Art created by spray painting

 Any item that in violation of Singapore’s Law

 Any items that are in conflict of the interest of the organizer



4.4 Reasonable space between stalls has to be maintained at all times as a safety precaution; stock and/or empty crates must not be stored outside the Applicant’s stall space during operating hours.


4.5 The Applicant is not allowed to bring his own tables or extensions, chairs, stools, etc. Additional chairs can be rented at $2 per day per chair, with prior arrangement with the Organizer.


4.6 The Applicant is allowed to bring only 1 clothes rack limited to 2ft (width) x 5ft (length) x 5ft (height).


Terms and Termination:
5.1 Organizer reserves the right to change the venue, date of Event at any point of time deemed necessary.


5.2 Organizer reserves the right to amend any terms and conditions without prior notice.


5.3 Organizer reserves the right to reject any application based on its absolute sole discretion; no refund will be given to rejections based breach to the terms and conditions.


5.4 Organizer reserves the right to terminate this contract immediately by notice in writing to the Applicant. Such termination shall not prejudice the rights and liabilities of either party against the other for any breach of this Contract.


Laws and Regulations:
6.1 The Applicant is responsible for complying with all applicable laws and regulations in Singapore as imposed by the Government or lawful bodies of the Republic of Singapore (including but is not limited to any item that breaches the intellectual property rights of any third party; any item that requires the prior approval of the relevant licensing authorities and for which prior approvals have not been obtained; any dangerous, offensive, pornographic or illegal items; any form of alcohol and counterfeit goods are strictly not allowed.


6.2 The Applicant deemed in breach of any applicable laws and regulations in Singapore will be asked to leave the Event without refund.



Best Interests of Organizer:

7.1 The Applicant undertakes at all time act in the best interest of Organizer and shall not do or permit anything that may damage or prejudice the reputation of Organizer or bring Organizer into disrepute.


Declaration of Sales:
8.1 The Applicant must declare to Sentosa Staff Daily Gross Sales report truthfully, at the end of the day.


Orderly Behavior of Vendor(s):
9.1 The Applicant is hereby given notice to conduct its business at the Venue in a professional manner so as not to give cause for complaints from other Applicants or the public and to ensure that the image of Organizer is not adversely affected. Vendor(s) shall respect the health and safety of fellow Vendor(s). No acts or threats of physical violence against another person (including sexual violence), disorderly conduct, and/or possession of dangerous articles (such as firearms, explosive materials, etc.) are allowed.



Abuse to Properties:
10.1 The Applicant is hereby given notice not to abuse by hanging or sticking anything onto the properties (Tents, Tables, Chairs, etc) provided by the Organizer.


Loss/Damage to Properties:
11.1 No property provided by the organizer shall be removed. The Organizer reserves the rights to report incident(s) of theft to the Police and it shall be dealt with under laws and regulations in Singapore as imposed by the Government or lawful bodies of the Republic of Singapore.


11.2 In the event of any loss/removal/damage caused to the venue and its furnishings/fixtures, The Applicant will be held liable for the loss, removal or damage and shall pay Organizer such sums as Organizer may determine for the loss or damage caused to the aforesaid.


Use of Space:

12.1 The Applicant shall not affix or otherwise exhibit or place on passageways, tents, bridge, pillars or the windows of the surrounding building or any part thereof any name-plate, signboard, placard, poster, banner or advertising material or offensive publications or any goods or articles or the like whatsoever for the purposes of any public announcement or which may contravene any statute or regulations or which may expose Organizer to any fine or penalty by reason thereof. The Applicant shall be held fully responsible and liable to pay the full fine or penalty caused to the aforesaid.


Losses:

13.1 The Applicant is allowed to place his goods or property overnight in the venue after operation hours fully at their own risk. For the avoidance of doubt, under no circumstances will the Applicant hold the Organizer responsible for any personal injuries, damage, lost or defacement of goods or property on display occurring, during, before or after the Event, no matter how it was caused.


Illumination and Electricity:

14.1 The Applicant is hereby given notice that no power points will be provided.


Cleanliness:

15.1 The Applicant is hereby given notice to keep the Facility clean and tidy, and shall not litter, deface or damage the Facility. The area must be cleared and kept clean after use, with the waste, boxes, cardboard and refuse should properly disposed of in the nearest bin centers.


Instructions for Loading and Unloading:

16.1 Coach Passengers to disembark at Coach Park, and walk to the Venue. Vehicle registrations to be provided to Organizer at least 1 week prior to arrival for access passes.
16.2 Private vehicles, to be parked at Beach Car park for unloading. Items to be hand carried via Sentosa Express to Venue. Parking charges apply.


Registration:
17.1 To be done online at http://www.adrenalin-portal.com.sg/kidzflea/, registration fees are strictly non refundable.


17.2 A validation check on members will be performed on the unique member ID for special offer on stall rentals. Any discrepancies will result in a required top up of the rental fee to the normal rate. Alternatively, registrants can opt for sign up for the Sentosa Islander Membership/The Jewel Card Membership/Port of Lost Wonder Membership Card to gain the preferential rate.



18. 1 Failure to abide by any of the above conditions would result in the early termination of the contract.
